Philly Man Arrested for Anti-Police Rant - Protected Speech or Not ?

PHILADELPHIA - JUNE 26, 2008 (WPVI) -- 44-year old Andre Moore is
being held at the 18th Police District by the very officers he
apparently wanted to kill.

At least that's the message he allegedy sent out to the world in a
disturbing, hate filled rant on YouTube.

"When you shoot the cops, you shoot them dead.", Moore is heard
saying.

Moore allegedly posted this video on the internet demonstrating how to
use a Colt .275 to shoot cops.

What police also find disturbing is that Moore is employed as a
security guard at Einstein Medical Center, the hospital where Officer
Chuck Cassidy died of gunshot wounds six months ago.

"We lost three police officers to guns on the streets of Philadelphia,
and this idiot's out there promoting this message.", said Thomas
Burke, of the Pennsylvania Gun Violence Task Force.

Moore's anger is directed mostly at the 18th district where he was
cited for minor offenses last month.

"I can't stand the 18th district," the videotaped rant continues.
"That's why I rejoice whenever they shoot a cop in Philadelphia.
'Cause I hate them."

And Moore dosen't stop there.

He goes on to promote violence in a city that is struggling to turn
the tide.

"Continue killing the 18th district police. I promote violence in
Philly. Promote violence in Philly."

Moore faces a number of charges, including aggravated assault.

And he's charged with corruption of minors.

That's because the cameraman is his 12 year old son.

And his son's 14 year old friend is seen in a follow up video posted
just yesterday.

Police used a battering ram on his door at six this morning.

   Now here's an interesting 1st-Amendment issue indeed :

   CLEARLY "political" speech ... would even pass the Bork Test.

   CLEARLY a revolutionary message, inciting violence against
   the existing authorities ... not really any different in
   theme, intent or content than the language say, Sam Adams,
   or Thomas Paine was using to stir up our (1st ?) revolutionary
   war - rants against a perceived, perhaps quite real, oppressors.

   Cops sma****ng in his front door with a ram was a nice, fascist,
   touch dontchathink ? Same goes for charging him for 'corrupting'
   his own son with his words. Vindication of Mr. Moores assertions ? 
   Bet that many will certainly SEE it as such ... and I'll damned
   well guarentee Moores son is 101% convinced. 

   The tone of the re****ting here too ... whining about injured
   cops ... but how many po' black people have the cops beaten,
   tazed, gassed, framed, harassed, and killed for no really
   good reason in Philly over the past couple of years ? Moore
   seeing them as "the enemy", a veritible "army of occupation"
   may be quite understandable. 

   We all know about the crimes of "Driving while black",
   "Walking while black", "Having money while Black", 
   "Standing while black" and "Breathing while black" even
   if we don't want to admit it. Those "crimes" are prosecuted
   by the police many many times a day, year-in, year-out, and
   we just kind-of look the other way and whistle Dixie ...
   keeps the low-life s*** in their place dontchaknow ..... 

   Now we PREFER to view things like Mr. Moores rant (or those
   of Rev. Wright) as "inciting a riot" ... unnecessary violence
   in a supposedly "free" country where people have the vote to
   change things. But how much do our votes REALLY count ? Are
   we getting a REAL choice or just "Powers-That-Be-Approved-
   Candidate #1" and "Powers-That-Be-Approved-Candidate #2" ???
   And the poor and minorities ... would they even get a break
   with President Obama and Attourney General Wright ??? 

   As the middle cl***** get abruptly poorer as this mult-
   pronged recession/depression thing deepens, we forget
   that it means the poor get even poorer too - meaning
   they're more pissed-off and desperate, meaning they're
   more heavily policed (or 'oppressed' maybe) by the
   authorities. 
   
   Many sides to this issue, many equally-valid "truths" to
   consider, many equally-valid points-of-view. 

   So ... what's yer call ? Is Moore a criminal - or the
   righteous spearpoint of an underclass revolution that's
   hit the boiling point ? Constitutionally-protected
   speech or not ? Truth or fiction ? Justice or injustice ?
   The new "John Brown" or "Malcom X" or just a self-serving
   little gangsta looking for licence to steal and kill ?
